In cases of suspension, your ability to deposit, wager, or withdraw funds may be temporarily limited while we investigate the matter. If your Account is permanently terminated due to a breach of these Terms or other serious misconduct, Winum may be required or entitled to withhold some or all of your remaining funds, including winnings, subject to applicable legal and regulatory requirements. In other situations, such as voluntary closure at your request or closure due to inactivity, any remaining balance may be returned to you, provided that your identity and payment details have been satisfactorily verified and no legal or regulatory impediments exist. You have the right to request the closure of your Account at any time by contacting customer support, although certain closures, such as self-exclusion, may carry specific conditions or minimum periods.
In the event of self-exclusion or responsible gambling-related closures, Winum will take reasonable steps to prevent you from re-opening your Account or creating new Accounts during the exclusion period. You agree not to attempt to circumvent such exclusions and acknowledge that doing so constitutes a serious breach of these Terms and undermines the protective purpose of responsible gambling measures. Winum may maintain records of suspended or terminated Accounts in order to comply with legal obligations, to prevent fraud, and to support responsible gambling initiatives.
Limitation of Liability

Winum does not guarantee that the Services will be uninterrupted, timely, secure, or error-free, or that any defects or malfunctions will be corrected immediately. Technical issues, internet connectivity problems, software or hardware failures, and other external factors may affect your ability to access or use the Services, and Winum shall not be responsible for losses resulting from such issues, except where explicitly required by law.
Nothing in these Terms shall exclude or limit Winum’s liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow the exclusion or limitation of implied warranties or certain types of damages, so the above exclusions and limitations may not apply to you in full. In such cases, Winum’s liability shall be limited to the maximum extent permitted by law.
Complaints & Dispute Resolution
Winum aims to provide high-quality Services and a fair gaming environment, but we recognize that disputes or complaints may occasionally arise. If you have any concerns or complaints regarding the Services, your Account, transactions, game outcomes, or any other matter, you should contact our customer support team as your first point of contact. Complaints should be submitted as soon as reasonably possible after the issue occurs and should include all relevant details, such as your username, the date and time of the incident, game or transaction identifiers, and a comprehensive description of the problem. By using the Services, you agree that any disputes that cannot be resolved through internal complaint procedures or alternative dispute resolution mechanisms may be brought before the competent courts in accordance with the Governing Law section of these Terms. You further agree that you will not initiate any chargeback or payment dispute without first attempting to resolve the matter through Winum’s complaint process, and that unjustified chargebacks may result in Account suspension, the recovery of funds, and the reporting of your conduct to relevant authorities or credit agencies.
Governing Law
These Terms, and any dispute, controversy, or claim arising out of or in connection with them or your use of the Services, shall be governed by and construed in accordance with the laws applicable to the operator of Winum, without regard to conflict of law principles that would result in the application of the laws of any other jurisdiction. You agree that the courts having jurisdiction over the operator’s registered office shall have exclusive jurisdiction to hear and determine any legal action or proceeding arising out of or in connection with these Terms or the Services, subject to any mandatory rights you may have under consumer protection or other applicable laws.
Nothing in this Governing Law provision shall prevent Winum from seeking injunctive relief or other equitable remedies in any jurisdiction where such relief is necessary to protect our interests, enforce these Terms, or address actual or suspected unlawful conduct. In all cases, you agree to submit to the personal jurisdiction of such courts and to waive any objections based on venue or forum non conveniens, to the extent permitted by law. If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a competent court or authority, the remaining provisions shall remain in full force and effect.
Final Provisions
These Terms constitute the entire agreement between you and Winum with respect to your use of the Services and supersede any prior or contemporaneous agreements, understandings, or representations, whether written or oral, relating to the subject matter hereof. No waiver of any provision of these Terms shall be effective unless it is in writing and signed by an authorized representative of Winum, and any failure or delay by Winum to enforce any right or provision shall not be deemed a waiver of such right or provision. You may not assign, transfer, or delegate any of your rights or obligations under these Terms without the prior written consent of Winum, and any attempted assignment in violation of this provision shall be null and void. Winum may assign or transfer its rights and obligations under these Terms, in whole or in part, to any affiliated entity or successor in interest, subject to applicable law and regulatory approvals.
You acknowledge that your use of the Services may also be subject to additional terms and conditions imposed by third parties, such as app stores (including where you download Winum for iOS), payment providers, or telecommunications operators, and that you remain responsible for complying with such third-party terms. In the event of any conflict between these Terms and the terms of third-party providers, these Terms shall prevail in relation to your relationship with Winum, except to the extent that third-party terms are explicitly made paramount by law.
Your continued use of the Services confirms your understanding and acceptance of these Terms and your commitment to responsible gambling, legal compliance, and fair play.
